Some of the most difficult issues in California marital dissolution cases involve public defined benefit retirement plans. When considering the appeal In re Marriage of Green, the Court of Appeal of California, First Appellate District, made the unusual move of, on its own motion, requesting the AAML Northern California Chapter file an amicus curiae brief. At the request of Chapter Amicus Committee Chair Diana E. Richmond, Chapter Fellows Barbara A. DiFranza and Ann Fallon wrote the brief, which the Court of Appeal opinion cited on multiple occasions. The Court of Appeal decision was reviewed by the California Supreme Court, which recently issued fundamental, far-reaching rulings in its decision In re Marriage of Green (2013) 56 Cal.4th 1130.
